3. Account Responsibilities

• You are responsible for maintaining the security and confidentiality of your account, including your login credentials.
• You agree to notify us immediately if you suspect any unauthorized use of your account.
• You must provide accurate and up-to-date contact and billing information. Failure to do so may result in account suspension or termination.

4. Acceptable Use Policy

You agree to use PyNoxi’s services for lawful purposes only. The following activities are strictly prohibited:

• a. Phishing, Scams, and Fraud: You may not use our services to engage in phishing, scam-related activities, or any attempt to fraudulently acquire sensitive information (such as login credentials or payment details) from others.
• b. Illegal Activities: You may not use PyNoxi’s services for any illegal activities, including but not limited to hosting, sharing, or distributing content that violates local, national, or international laws. This includes, but is not limited to, child exploitation, drug trafficking, counterfeit goods, and pirated software.
• c. Malicious Activity: You are prohibited from using our services to create, store, or distribute malware, viruses, Trojan horses, ransomware, or any other harmful software. Engaging in denial-of-service (DoS) attacks, hacking, or any other actions aimed at disrupting the services of others is also prohibited.
• d. Spam and Unsolicited Communication: You may not use PyNoxi services to send unsolicited bulk emails (spam), engage in mass email marketing without consent, or run mailing lists that violate anti-spam laws.

5. Resource Usage

PyNoxi offers different hosting plans, each with its own limits on storage, bandwidth, CPU usage, and other resources. You agree not to exceed the resource limits specified in your hosting plan. Excessive use may result in service suspension, additional fees, or a request to upgrade to a higher plan.

6. Payment, Fees, and Refunds

• Payment: You agree to pay all fees for services rendered by PyNoxi according to the payment schedule indicated during checkout.
• Billing: We may automatically bill you for recurring services (e.g., monthly hosting plans). It is your responsibility to ensure your payment information is current to avoid service interruptions.
• Refunds: We offer a 7-day money-back guarantee for web hosting and reseller services. Refund requests must be made within 30 days of the initial purchase. After 30 days, all payments are non-refundable.

7. Termination of Services

PyNoxi reserves the right to suspend or terminate your account at our discretion, without notice, for the following reasons:

• Violation of Terms: If you breach any of the terms outlined in this agreement, we may terminate your account or suspend services immediately.
• Illegal or Harmful Activities: Engaging in illegal activities, hosting phishing sites, distributing malware, or violating our Acceptable Use Policy will result in immediate account termination.
• Non-Payment: Failure to pay for services on time may result in suspension or termination of your account. Your data may be permanently deleted after 15 days of non-payment unless otherwise arranged.
• Inactivity: If your account remains inactive for an extended period (e.g., 6 months), we may terminate it after sending a warning notice.

8. Data and Backup Responsibility

While PyNoxi performs regular backups of web hosting accounts, you are ultimately responsible for maintaining up-to-date backups of your own data. PyNoxi is not liable for any data loss caused by server failures, attacks, or other incidents.

9. Limitation of Liability

While we strive to offer a 99.9% uptime, PyNoxi is not responsible for any downtime, service interruptions, or loss of data.

• No Warranties: Our services are provided on an “as is” basis without warranties of any kind, either express or implied.
• Liability Cap: PyNoxi’s total liability to you for any damages, losses, or causes of action shall not exceed the amount paid by you for the services during the 12 months preceding the incident.

10. Indemnification

You agree to indemnify and hold PyNoxi, its affiliates, employees, and partners harmless from any claims, damages, liabilities, or expenses arising out of your use of our services, violation of these Terms, or infringement on any third party’s rights.

11. Copyright and Intellectual Property

You may not host or distribute any content that infringes on the intellectual property rights of others, including copyrighted material, trademarks, and patents. PyNoxi respects intellectual property laws and will comply with any valid Digital Millennium Copyright Act (DMCA) takedown requests or similar legal demands.

12. Third-Party Services and Software

Some of our services may include software or services provided by third parties. You agree to comply with the terms of use for such third-party software and services. PyNoxi is not responsible for the availability or performance of third-party software, nor any damages that may result from its use.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the country/state in which PyNoxi operates, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

14. Changes to the Terms of Service

We may update or modify these Terms from time to time. We will post any changes on our website and, where appropriate, notify you by email. Continued use of our services after changes to the Terms constitutes your acceptance of the new terms.
